Terms of Service

1. Agreement

By accessing or using Marketing Activities Centre ("MAC", "the Service"), provided by Honeycomb Creative Inc. ("we", "us", "our"), a company incorporated in British Columbia, Canada, you ("Customer") agree to be bound by these Terms of Service. If you are accepting on behalf of a company, you represent that you have authority to bind that company.

2. The Service

MAC is a subscription-based CRM and email marketing platform that allows businesses to manage contacts, automate email sequences, track sales pipelines, and monitor campaign activity.

3. Account Registration

You must provide accurate information when creating an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately of any unauthorized access.

4. Subscription & Payment

Access to MAC requires a paid subscription.
Fees are billed monthly or annually depending on your selected plan.
Subscriptions renew automatically unless cancelled before the renewal date.
All fees are in Canadian dollars and are non-refundable except as required by law.
We reserve the right to change pricing with 30 days' written notice.

5. Acceptable Use

You agree not to use MAC to:

Send unsolicited commercial messages (spam) in violation of Canada's Anti-Spam Legislation (CASL) or any applicable law
Upload or transmit harmful, unlawful, or infringing content
Attempt to gain unauthorized access to the Service or other users' accounts
Resell or sublicense access to the Service without written permission

You are solely responsible for all content you send through MAC and for compliance with CASL and any other applicable anti-spam, privacy, or marketing laws.

6. Data & Privacy

We collect and process personal information in accordance with our Privacy Policy and applicable Canadian privacy law, including the Personal Information Protection Act (BC PIPA) and PIPEDA. You retain ownership of all data you upload to MAC. We will not sell your data to third parties.

7. Intellectual Property

MAC and all associated software, designs, and content are owned by Honeycomb Creative Inc. and protected by applicable intellectual property law. These Terms do not grant you any rights to our trademarks, logos, or proprietary technology beyond what is necessary to use the Service.

8. Confidentiality

Each party agrees to keep the other's confidential information private and not to disclose it to third parties without prior written consent, except as required by law.

9. Disclaimer of Warranties

The Service is provided "as is" and "as available." We make no warranties, express or implied, regarding reliability, accuracy, or fitness for a particular purpose. We do not guarantee uninterrupted or error-free operation of the Service.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Honeycomb Creative Inc. shall not be liable for any indirect, incidental, special, or consequential damages, including loss of profits or data. Our total liability to you for any claim arising under these Terms shall not exceed the fees paid by you in the three months preceding the claim.

11. Termination

Either party may terminate the subscription at any time. Upon termination, your access to the Service will cease at the end of the current billing period. We may suspend or terminate your account immediately if you breach these Terms.

12. Changes to Terms

We may update these Terms from time to time. We will notify you by email or in-app notice at least 14 days before material changes take effect. Continued use of the Service after that date constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein. Any disputes shall be resolved in the courts of British Columbia.
